French measures to monitor the workload of employees subject to a working time arrangement in days

The company collective agreement providing for the possibility to organize the employees’ working time in days over the year must set out the methods for measuring and monitoring the workload of the employees concerned.

In a decision dated October 5, 2017, the French Supreme Court considered that, in addition to the documents that the employee must regularly give to his/her superior stating his/her workload, the company collective agreement should provide for regular and effective monitoring measures that the employee’s superior must put in place in order to be able to address in a timely manner issues potentially arising from an employee’s workload that has become inconsistent with a reasonable working time duration.

To avoid the invalidation of annual working time arrangements in days, it is therefore not sufficient to simply order employees to fill in reports of their working times. The employer should also ensure a regular and effective monitoring. A self-declaration system is not sufficient to ensure that the employee’s working time duration complies with the legal daily and weekly rests.

Modalités du suivi effectif de la charge de travail des salariés en forfait annuel en jours

L’accord collectif d’entreprise organisant le recours au forfait annuel en jours doit notamment fixer les modalités d’évaluation et de suivi régulier de la charge de travail des salariés concernés.

Par un arrêt du 5 octobre 2017, la Cour de cassation vient rappeler le principe selon lequel, outre la remise d’états récapitulatifs réguliers de son temps de travail par le salarié à sa hiérarchie, l’accord collectif doit prévoir un suivi effectif et régulier par la hiérarchie de ces derniers afin de pouvoir remédier, en temps utile, à une charge de travail éventuellement incompatible avec une durée raisonnable.

Pour éviter toute invalidation du forfait annuel en jours, il ne suffit donc pas d’imposer aux salariés concernés qu’ils transmettent leurs récapitulatifs de temps de travail. L’employeur doit également en assurer un suivi effectif et régulier, un système auto-déclaratif ne pouvant à lui seul garantir effectivement le respect de durées raisonnables de travail, ainsi que des repos journaliers et hebdomadaires.
