A new change in strategy for LEXELLENT is enriching its structure by increasing the range of services being offered to clients.

In view of the evolution of the relationship between businesses and their employees, LEXELLENT is revolutionizing its structure to keep pace with the true needs of its clients.

Professionally this change is being realized through an increase in the types of services which the firm can offer its clients. This is because LEXELLENT’s team knows, through over 3 decades of experience working in the field, that effective human resource management takes more than just a knowledge of the Italian civil code. Today, it is not enough to just provide assistance to businesses with litigation cases in court… or advice on an employment contract,” explains LEXELLENT Founding and Managing Partner Sergio Barozzi. “There is a transformation, at a global scale, which is taking place in the field of employment and labour law. In Italy, the changes taking place are even more pronounced because the management of the relationship between employers and employees is clearly over regulated: Italy is probably the only country in the world with a Labour Code which aggregates close to 50,000 regulations. This is undoubtedly a negative factor which not only weighs on competitiveness but also scares multi-nationals looking to invest in our beautiful country. Then there is also the generic question of taxes and bureaucracy.”

In 2013, a study conducted by the International Monetary Fund (IMF), indicated that among the negative factors is the imbalance contained within the management of employment relationships – in addition to the absence of the execution of reforms. These are principal factors for growth – which are not there. The weight is quantifiable at 2.3% of Italy’s annual GDP. In other words, bad management of working relationships and organization, including litigation between employers and their employees, costs Italy and its businesses, each year on average an astonishing Euro 34 billion.”

When one thinks of employment lawyers,” adds Sergio Barozzi, “one almost always refers to a conservative vision – that is, something which is useful when litigation is required – thus associating the profession with something that is traumatic and costly.”

In reality our job is to help businesses manage the entire relationship with their employees – in all of its complexity. For example, the protection of a company’s assets, where its integrity is fully dependent on the trustworthiness of the employees: this is an area which today has been treated as a sealed compartment, as if it did not regard the integrity of the entire company. Or health and safety in the workplace, which is usually trusted to an engineer working independent of the professionals that would assist a client in any related litigation.”

LEXELLENT has a different vision,” concludes Sergio Barozzi. “It is to provide 360° assistance to clients, as doctors do, in that – the goal is not just to diagnose and to cure but also to prevent…in our case the prevention of litigation or anything that could possible cause it.

Renato D’Andrea has 30 years of experience providing Intellectual Property counsel to both national and international businesses of all sizes – defending their technical and commercial know-how in addition to their distinctive  hallmarks. He has a wealth of experience advising clients on the protection of their Intellectual Property – in addition to defending these rights in cases involving detrimental actions by both current and former employees.

Francesco Bacchini is an Adjunct Professor of Employment Law, Industrial Relations, and Trade Union Law at the University of Milan ‘Bicocca’. His practice focuses on health and safety in the workplace, corporate welfare, social innovation, as well as labour and volunteering. Francesco is a sought after consultant to important Italian institutions such as Confindustria – the Italian employers’ federation which brings together over 100,000 Italian businesses which together manage over 4 million employees.
