SYNTEC: the compensation of interventions during on-call duty maintained in case of sick leave.

Article 43 of the Syntec Collective Bargaining Agreement provides that in case of sick leave, the employer must pay a sum which completes the benefits of the Social Security and occupational insurance schemes, up to what the employee would have received if he had been working. This excludes bonuses and extra ordinary gratifications.

In the case at hand, the employee was carrying out various tasks during his on-call duty and was receiving variable compensations each month.

The French Supreme Court ruled that the continuation of remuneration in case of sick leave must take into account the average compensation received monthly during the 12 months of on-call duty which preceded the leave.

This solution is transposable to other Collective Bargaining Agreements (Metallurgy, Bank, Financial Corporations, Service Providers, Road Transport, Chemistry, etc…)

SYNTEC: la rémunération des interventions pendant les astreintes maintenue en cas d’arrêt maladie
L’article 43 de la Convention Collective Syntec prévoit qu’en cas d’arrêt maladie, l’employeur doit verser une somme qui complète les versements de la Sécurité sociale et des régimes de prévoyance, à concurrence de ce que le salarié aurait perçu s’il avait travaillé, non compris primes et gratifications.

Dans cette affaire, le salarié effectuait chaque mois des interventions pendant ses astreintes et recevait à ce titre un montant variable chaque mois.

La Cour de Cassation décide que son maintien de salaire en cas d’arrêt maladie doit prendre en compte la moyenne des rémunérations des interventions pendant les astreintes au cours des 12 derniers mois précédant l’arrêt.

Cette solution est transposable à d’autres conventions collectives (Métallurgie Ingénieurs et Cadres, Banque, Sociétés Financières, Prestataires de Services, Transport Routier, Chimie, etc…).
